At Elevate HR and Search LLC-FZ ("we", “us,” “our” or "Elevate HR"), are committed to protecting the privacy and personal information of our clients, candidates, and website (www.elevatehr.ae) visitors. This Privacy Policy (the “Privacy Policy”) outlines how we collect, use, process, store, disclose, and safeguard your information when you use our services, visit our website, submit your CV, apply for jobs through our website and external job boards or interact with us in any way.

 

We act as a data controller to ensure that the data you supply to us is processed fairly and lawfully, and used only for the purposes set out in this Privacy Policy. It is important that you read this Privacy Policy as it informs you how we protect personal data and about your privacy rights.

 

By using our services or accessing our website, you acknowledge that you have read and understood this Privacy Policy and agree to its terms.  You also declare that by accessing, browsing or using the website and/or by submitting personal data to us, you have legal capacity and you are 18 years old or above. Our website is not intended for children and we do not knowingly collect personal data relating to children.

If you do not agree to our processing of your data in the manner outlined in the Privacy Policy, please do not submit any personal data to us.

Personal data is any information relating to an identified or identifiable person.  We will only collect personal data that we are permitted to collect by law on a jurisdictional basis. We have set out below a non-exhaustive list of the types of personal data that we most commonly collect.

3. How we collect personal data 

We generally collect your personal data directly from you. For example, we collect your personal data when you:

  • register with us (e.g. at career fairs);

  • submit any other information to us, such as a CV;

  • subscribe to job alert emails;

  • subscribe to our publications;

  • attend an event we have organised; and/or

  • give us feedback.

  • pre-employment screening and background checking organisations where permitted in the jurisdiction;

  • our clients; 

  • governmental and regulatory bodies;

  • third party suppliers, including job board providers and job aggregators;

  • other recruitment agencies; and

  • analytics providers, such as Google Analytics.

 

We may also collect your personal data from publicly available sources where permitted in the jurisdiction, including:

  • your identity and historical data from social media sites, such as LinkedIn, Twitter, Instagram and Facebook;

  • your identity and contact data from company and commercial registers; and

  • your identity, from qualification and membership lists of professional bodies.

4. How We Use Your Personal Data

We use, process, disclose and store your personal data that we collect during our candidate registration process to assist with any job application(s), for the purposes of providing you with employment search opportunities and career-related information through this website and by email sent to you from our recruitment consultants. We process your personal data to evaluate your suitability for roles, conduct applicable background and verification checks and disclose your personal data to our clients and potential hiring organisations in relation to their job vacancies. We will process your personal data in accordance with the core provisions in the Federal Decree Law No. 45 of 2021 on Personal Data Protection and for our legitimate business purposes. If you provide us with personal data about third parties, you are the source of that information and we will assume that the third party has given you permission to do so and to Elevate HR collecting, processing and transferring their personal data to the same extent as yours.

 

Our success is dependent on efficiently matching candidates to clients’ vacancies. Our recruitment consultants decide which candidates to shortlist for a specific client’s job, based on their expertise, knowledge of the job market, requirements for the role, overall fit with the clients business, candidate discussions and other relevant criteria. Clients’ (through their internal hiring process) decide which candidate(s) to select for interview (if any). Our clients’ hiring personnel make the final decision on which candidate to select for their job (if any) and ultimately to proceed to hire/engage/employ the candidate.

 

Recruitment: We use the collected information to assess your suitability for job opportunities, to connect candidates with potential employers and to facilitate the recruitment process.  Your personal data will be collected and handled by us in order to:

  • provide our full range of recruitment services to you and to facilitate the recruitment process;

  • provide career, recruitment and/or related intermediary services to or for you;

  • assess your data against vacancies which we judge may be suitable for you;

  • enable you to submit your CV, apply for specific jobs or to subscribe to our job alerts so that we can notify you when relevant job vacancies arise;

  • send your information to clients in order to apply for jobs or to assess your eligibility for jobs;

  • fulfil our contractual obligations to our clients; 

  • provide you with further information which may be of interest to you in regard to the employment market and opportunities; 

  • send you details of networking and client events, and general information about the industry sectors which we think might be of interest to you where you have consented to being contacted for such purposes

  • allow third parties who provide services that we, you or our client have requested including conducting pre-employment screening, references, qualifications and criminal reference checking services

  • assist third parties, regulatory or law enforcement agencies if we believe in good faith that we are required by law to disclose it in connection with the detection of crime, the collection of taxes or duties, in order to comply with any applicable law or order of a court of competent jurisdiction, or in connection with legal proceedings

  • answer your enquiries or questions;

  • conduct statistical analysis;

  • monitor diversity; and

  • pursue or defend a legal claim.

Website users: Your personal data will be collected and handled by us in order to:

  • improve our customer service to make our services more valuable to you and make the way we operate more useful to you;

  • let you know about our HR, Recruitment and Coaching services; and

  • send you communications where you have indicated you are happy to receive such information.

 

We reserve the right to transfer your information to a third party in the event of a sale, merger, liquidation, receivership or transfer of all or substantially all of the assets of Elevate HR provided that the third party agrees to adhere to the terms of this Privacy Policy and provided that the third party only uses your personal data for the purposes that you provided it to us. You will be notified in the event of any such transfer and you will be afforded an opportunity to opt-out.

5. Applicants for Roles with Elevate HR

If you are a job applicant applying for a role within Elevate HR, we will collect personal data from you via your CV, during in-person and video interviews, referees, professional and educational organisations, online assessments and other sources. We will process your personal data on the basis of legitimate interests for the purposes of administering the employment application, managing the internal hiring process and assessing your suitability for the role. We will store your personal data securely in our confidential online HR database. We take steps to ensure that your personal data is adequately protected and kept confidential. If we engage a third party to provide pre-employment screening services or testing, we will ensure that access is limited to the personal data that is compatible with those purposes and the service provider is contractually obliged to comply with applicable data privacy laws, confidentiality and provide adequate safeguards to keep your personal data secure until it is deleted or anonymised so that you can no longer be identified.

If your employment application is unsuccessful, we will retain your personal data on our HR database for a period of six (6) months for the purposes of evidencing that we have conducted the hiring process in a fair and transparent way. At the end of the retention period, your personal data will be deleted. From time to time we may ask if we can retain your name, CV and contact data for a longer period if we consider that you may be suitable for future roles. We will only do this with your consent. You can withdraw consent at any time and we will delete your personal data.

 

6. Who your personal data is shared with â€‹

Subject to local regulations in the jurisdiction, we may disclose your personal data to:

  • potential employers or clients as part of the recruitment process;

  • other recruitment companies or intermediaries involved in managing the supply of personnel;

  • data processors of Elevate HR;

  • pre-employment screening and background checking organisations;

  • your referees;

  • your past employers and relevant education institutions;

  • your professional bodies;

  • third party providers, including job board providers and job aggregators, managed service providers, IT support or website hosting.

  • third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business structure, any new owners may use your personal data in the same way as set out in this Privacy Policy.

These third party service providers are bound by confidentiality agreements and are only permitted to use your information for the purpose of providing their services to us. We do not allow third party processors to use your personal data for their own purposes, they will be required to hold your personal data securely.  We also do not sell, rent, or trade your personal information to third parties for marketing purposes.

 

Your personal data may be made available to the courts, government departments, appropriate regulatory and supervisory authorities and other third parties to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to:

 

(a) comply with the law requiring such disclosure;

(b) protect the rights or property of Elevate HR;

(c) prevent crime, protect national security or for fraud detection and prevention; and/or

(d) protect the online safety of individuals using our website or members of the public.

 

We may process your personal data without your knowledge or consent in compliance with the above rules, where this is required or permitted by applicable law. In circumstances where third parties are controllers, they will be responsible for processing your personal data for their purposes and we may not be able to impose obligations or restrictions in connection with how they process your personal data (e.g. government and public authorities and law enforcement agencies).

 

7. Personal data storage and transfer

The personal information that you provide to us will be stored in the United Arab Emirates and may be shared with clients and the third parties specified above. However, your personal information may also be sent to or be capable of being accessed both from within and outside the United Kingdom or the European Economic Area. When we transfer your personal information outside the European Economic Area we will take steps with the aim of ensuring that your privacy rights continue to be protected as outlined in this Privacy Policy.

 

8. Data Security

We implement industry-standard security measures to protect your personal data from accidental and unauthorized access, loss, misuse, alteration, or disclosure. However, no method of transmission over the internet or electronic storage is 100% secure and we cannot guarantee its absolute security; any transmission is at your own risk.

 

In addition, we limit access to personal data to those employees, agents, contractors and other third parties who have a business need to know. We have agreed on security-related measures with the third parties we share your personal data with to ensure that it is treated by those third parties in a way that is consistent with how we safeguard your personal data. They must only process your personal data on our instructions and they are also subject to a duty of confidentiality.

 

We have also put in place procedures in the event of a suspected personal data breach and we will notify you and the relevant supervisory authorities when we are legally required to do so.

9. How long we Retain your Personal Data

We are required by law to hold your information for as long as is necessary to comply with our statutory and contractual obligations and in accordance with our legitimate interests as a data controller.  Therefore, we will retain your personal data for as long as necessary to fulfil the purposes that we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements.  This means we will keep your personal data throughout the period of your relationship with us and whilst we are providing you with work finding services, administering a job application and keeping in contact with clients and hiring organisations.

 

If you no longer wish to receive our services, you can request us to delete your personal data and we will appropriately and securely dispose of your personal data.  We may continue to retain some of your personal data for applicable legal, compliance, accounting and tax purposes. Your name may be included in financial and transaction data (e.g. client invoices and receipts) for up to 7 years from when our relationship ends. The type of data we retain depends on the nature of our relationship with you and the services we have provided.

 

10. Your Options

We will use reasonable endeavours to ensure that your Personal Data is maintained and up to date However, you have the right to request access, update, correct and delete your personal information. You can also withdraw consent at any time, where the basis for processing your personal data is consent, and opt out of receiving marketing communications from us by contacting us at enquiries@evelatehr.ae.

 

If you want to access your personal data, we may need to request specific information from you to help us verify your identity before we can respond to your request. If you are making a request on behalf of someone else, then we will ask for information to satisfy us of your identity and for information to show you have authority to act on someone else’s behalf. This is a security measure to ensure that personal data is not accessed or disclosed to any person other than the individual who has the right to the data. We may also contact you to ask you for further information in relation to your request to help us locate personal data we hold and to speed up our response time.

 

Where permitted by law, you may be charged a fee to access your personal data or to exercise any other right that may apply. We will let you know if a fee applies to your request before we complete it. 

 

We will respond to all legitimate requests within any legal timeframes. 

 

11. Marketing Messages

We will ask you for consent to send you direct marketing communications via email. You may also receive email marketing messages from us if you provided us with your details when you registered for a networking event or attended a training course and you have given us consent to send you marketing. If you give us consent, we may also use your identity, contact details, technical data, usage data and profile data to form a view and decide which services may be of interest or relevant for you. You have the right to withdraw your consent to marketing at any time by contacting us at enquiries@elevatehr.ae.

 

We will never sell or disclose your personal data to any third parties to use for marketing.

 

12. Links to other websites

Our website may include links to third party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third party websites and are not responsible for their privacy statements.

We collect your personal data automatically via cookies when you visit our website, in line with the cookies settings in your browser. 15. Changes to our Privacy Policy

We reserve the right to change this Privacy Policy from time to time to reflect changes in our practices and services. Changes will be notified on our website seven (7) days before taking effect and the date in the Last Updated section of this Cookies Policy will be revised to reflect this. We may make emergency changes to this Privacy Policy when we believe it is reasonable to do so e.g. to comply with legal or regulatory requirements.
